www.aacars.com is a site operated by Used Car Sites Limited t/a VCARS ("We / Our / Us").

We use the AA name, brand and logo under license from Automobile Association Developments Limited (company number 1878835, England) ("the AA"). The AA's VAT number is 188 0311 10.

VCARS is registered in England and Wales under company number 4546950 and has its registered office at Millers House, The Maltings, Roydon Road, Stanstead Abbotts, Hertfordshire, SG12 8HN. VCARS VAT number is 806075443.

Access to AA Cars History Check is subject to a fair use policy and is made available for non-commercial purposes only. Access to free AA Cars History Checks may be withdrawn or suspended at any time without notice.
  19. 4.3 The content on the AA Cars website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the AA Cars website. In particular, We and the AA recommend that you seek the advice of a suitably qualified mechanic / vehicle expert before purchasing any car advertised on the AA Cars website.

  23. 5.3 We, the AA are not the seller of the vehicles advertised on the AA Cars website, and we accept no responsibility for such vehicles. Please contact the seller of the vehicle if you experience any difficulties.
  24. 5.4 Nothing in these terms of use excludes or limits Our liability or the liability of the AA for death or personal injury arising from our respective negligence, or our respective fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
  25. 5.5 To the extent permitted by law, We, the AA exclude all conditions, warranties, representations or other terms which may apply to the AA Cars website or any content on it, whether express or implied.
  26. 5.6 We, the AA will not be liable to any user of the AA Cars website whether in contract, tort (including negligence), breach of statutory duty, or otherwise for the following losses and / or damage:
  27. 5.6.1 foreseeable losses;
  28. 5.6.2 direct losses;
  29. 5.6.3 loss of profits, sales, business, or revenue,
  30. 5.6.4 business interruption,
  31. 5.6.5 loss of anticipated savings,

  35. 5.7 We, the AA will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the AA Cars website or to your downloading of any content on it, or on any website linked to it.
  36. 5.8 We, the AA will not assume any responsibility for the content of websites linked on the AA Cars website. Such links should not be interpreted as endorsement by Us, the AA of those linked websites. We, the AA will not be liable for any loss or damage that may arise from your use of them.
  37. 5.9 If you are a consumer, you may have legal rights in addition to the rights set out in these terms and conditions. Advice about your legal rights is available from your local Citizen's Advice Bureau or Trading Standards office. Nothing in these terms and conditions will affect these legal rights.
  38. Intellectual Property Rights
  39. 6.1 We are the owner or the licensee of all intellectual property rights in the AA Cars website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  40. 6.2 You may print off one copy, and may download extracts, of any page(s) from the AA Cars website for your personal use and you may draw the attention of others within your organisation to content posted on the AA Cars website.
  41. 6.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

  46. Viruses
  47. 7.1 We do not guarantee that the AA Cars website will be secure or free from bugs or viruses.
  48. 7.2 You are responsible for configuring your information technology, computer programmes and platform in order to access the AA Cars website. You should use your own virus protection software.
  49. 7.3 You must not misuse the AA Cars website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the AA Cars website, the server on which the AA Cars website is stored or any server, computer or database connected to the AA Cars website. You must not attack the AA Cars website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.   55. How to make a complaint
  56. 10.1 Complaints about the AA Cars website or the AA Cars History Check product:
  57. 10.1.1 We aim to provide you with a high level of service at all times. However, there may be a time when you feel that our service has fallen below the standard you expect.  If this is the case and you want to complain, we will do our best to try and resolve the situation.

  58. 10.1.2 Text Relay is available for deaf, hard of hearing or speech impaired customers.
  59. 10.1.3 We will either acknowledge your complaint within 5 working days of receipt, or offer you our final response if we have concluded our investigations within this period.
  60. 10.1.4 If we acknowledge your complaint, we will advise you who is dealing with it and when we expect to respond.  We aim to respond fully within 8 weeks.  However, if we are unable to provide a final response within this period we will write to you before this time and advise why we have not been able to offer a final response and how long we expect our investigations to take.
  61. Use of your personal information
  62. 11.1 Your personal information will be used in accordance with the terms of the AA Cars privacy policy.
  63. 11.2 In particular, your personal information will be used by:
  64. 11.2.1 The AA and the Acromas group of companies who will use it for marketing and other purposes. Full details are contained in the AA Cars privacy policy; and
  65. 11.2.2 Vehicle Dealers in connection with vehicle enquiries you submit to them via the AA Cars website. Please see the AA Cars privacy policy for full details.
  66. Other important terms
  67. 12.1 This contract is between you and Us. Save for the protections and rights afforded to the AA in clauses 4.4 (Costs & Nature Of Content) and clause 5 (Our Liability To You) and to the AA in clause 6 (Intellectual Property Rights), no other person shall have any rights to enforce any of these terms under the Contracts (Rights of Third Parties) Act 1999. The AA's consent shall not be required to terminate, rescind or agree any variation, waiver or settlement under these terms.
  68. 12.2 Each of the clauses and sub-clauses of these terms operates separately. If any court or relevant authority decides that any of them (or any part of them) are unlawful, the remaining clauses, sub-clauses and / or part(s) of the clause or sub-clause (as appropriate) will remain in full force and effect.
  69. 12.3 If We or the AA fail to insist that you perform any of your obligations under these terms, or if We, the AA do not enforce our respective rights against you, or if we delay in doing so, that will not mean that We, the AA (as appropriate) have waived our respective rights against you and will not mean that you do not have to comply with those obligations. If We, the AA do waive a default by you, we will only do so in writing, and that will not mean that We will automatically waive any later default by you.
  70. Applicable lawful
  71. 13.1 If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
  72. 13.2 If you are not a consumer, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

  3. In order to conduct an AA Cars History Check search, the vehicle against which you wish to search must be registered in the United Kingdom (including Northern Ireland). For the avoidance of doubt, this does not include vehicles registered in the Channel Islands or the Isle of Man.

  3. Except as otherwise stated in clause 9.4, our aggregate liability to you arising out of or in connection with the Services provided on or in connection with the Website shall not exceed £100.

  1. You are free to stop using the Services at any time.

Please note, because you agree before placing your order for the Services that we can begin to set up and provide the Services immediately following your request, you do not have a statutory right to cancel the Services. However if, after you have placed your order, you no longer want the Service, you are under no obligation to use the AA Cars History Check search information provided or even to review it.
  3. We may terminate or suspend your access to the Services and any future Services available via the Website without notifying you if:
  1. in our view there has been a serious failure by you to comply with your responsibilities in these Terms and Conditions (for example misuse of Our Materials or for fraud), or
  2. If we do so, we may delete our records of your registration details and Your Data without liability to you.

  3. In order to conduct an AA Cars History Check search, the vehicle against which you wish to search must be registered in the United Kingdom (including Northern Ireland). For the avoidance of doubt, this does not include vehicles registered in the Channel Islands or the Isle of Man.

AA Cars History Check Service does not provide information on (a) the physical condition of any vehicle, (b) the roadworthiness or safety of any vehicle, (c) whether the vehicle has been "written off" (unless it was written off by an insurance company), (d) whether any vehicle is a "clone" bearing a false vehicle registration mark and vehicle identification number, or (e) whether any vehicle was originally purchased and/or imported from another European Union country other than the UK. You will need to make your own investigations if you require information on any of these aspects of any vehicle(s) you own or intend to purchase.

When it comes to your privacy we never compromise. We will always be clear about why we need the details we ask for, and ensure your personal information is kept as secure as possible. How we do this is explained below.

Introduction

The AA Group ('we' 'us') means AA plc, together with any entity in which AA plc directly or indirectly has at least a 50% shareholding. The AA Group use a variety of well-known brand and trading names including, but not limited to, AA, BSM, Go Travel Insurance, 1Stop Travel Insurance and Peak Performance. The AA Group are committed to protecting your privacy. We comply with the principles of the Data Protection Act 1998 and aim to maintain best-practice standards in our processing of personal and/or sensitive personal data.

How we use your information

We use the information we receive from you, together with information we have obtained from our dealings with you (including in relation to goods and/or services we provide to you and/or your use of those goods and/or services), to provide goods and/or services that you request, to communicate with you, and to personalise information sent to you. Examples of how we may personalise information include using your information in generating an insurance quote for you or when we will be delivering certain products in your area.

To help us prevent fraud and money laundering, your details may be submitted to fraud prevention agencies and other organisations where your records may be searched. We will also conduct a search with a credit reference bureau to assist us in providing a quote, and to check which payment options we can make available to you. A copy of this search will be left on your credit file but will not affect your credit score. Where we are providing a motor insurance quotation this search will be noted on your credit file and may be reflected in your credit score.

Third parties may deliver some of our products to you, or provide all or part of the service requested by you. In these instances, while the information you provide will be disclosed to them, it will only be used for the administration of the service provided (including for example verification of any quote given to you and claims processing), underwriting and pricing purposes as appropriate, testing, and to maintain management information for business analysis.

If you apply for the AA Credit Card, we, or the supplier of the card, will search your record at a credit reference agency. If you apply for other financial services and/or products, a check of your details with fraud prevention agencies may be necessary. The precise nature of these processes is explained fully when you apply.

We ask for your home, mobile phone number, and email address to enable us to contact you in relation to an enquiry you have made, to contact you about relevant products or services, to contact you if there is a problem with your order, or there is another genuine reason for doing so.

We make outbound phone calls for a number of reasons relating to our many products, including breakdown cover and insurance. We are fully committed to the regulations set out by Ofcom and follow strict processes to ensure we comply with them.

If you provide us with credit or debit card details in order to pay for a service or product, we will keep such details secure and ensure that the details are only used further with your consent and/or for the purposes of any appropriate refunds.

When you enter a contest or other promotional feature, we may ask for your name, address, phone numbers and email address so we can administer the contest and notify winners.

Occasionally, we may also use the information we collect to notify you by post, phone, mobile phone, email and SMS about new or existing services, products and special offers we think you'll find of interest.

We may use sensitive personal data collected in respect of one product to market another appropriate product to you.

Generally by providing the requested data you consent to us using that data for administrative purposes and for informing you of other products and services by letter, SMS, phone and/or email. A customer may properly give their spouse's or partner's consent over the phone or via the website providing the customer confirms they have permission to do so. If the consent is written, the spouse must independently endorse such consent.

From time to time the AA Group may use service providers and organisations outside the EEA for the purpose of processing services, system testing and maintenance.

It is worth noting, however, that some non-EEA countries do not afford the same level of data security as the UK. By submitting your details you consent to this transfer. We will always use every reasonable effort to ensure sufficient protections are in place to safeguard your personal information.

Subsequent to your purchase of a product or service, we may enter into an arrangement for that service to be provided by a new third party. If you are entitled to breakdown service under AA membership you consent to the AA Group keeping you up to date with the AA Rewards discount scheme or similar available from time to time. Under this, as part of the benefit of being a member, the AA Group will, through the AA members' magazine, email or otherwise, give you membership information and details of any discounts or offers it may negotiate from time to time on behalf of its members.

Disclosure of information to third parties

As previously mentioned, we do not sell, trade or rent your information, and will never disclose information about you (including information obtained from our dealings with you) to third parties, except:

The AA Group have adopted the following procedure in gaining your consent to be placed on its marketing lists.

When you first make an enquiry of or buy a product from the AA Group you consent to receiving marketing about other products and services from us. Your details are placed on our marketing list for the AA Group and a 'questionnaire' will be sent to you; it may be sent electronically. This questionnaire gives a list of all the products of the group, and the option of choosing which products you would or would not like to receive information about. You can also choose not to receive any marketing from us. Once you have chosen what you would like to receive we ask you to return the completed form back to us. The marketing selections will be administered where applicable.

Amendment and retention of information
