www.theaacars.com is a site operated by Used Car Sites Limited t/a VCARS ("We / Our / Us").

We use the AA name, brand and logo under license from Automobile Association Developments Limited (company number 1878835, England) ("the AA"). The AA's VAT number is 188 0311 10.

VCARS is registered in England and Wales under company number 4546950 and has its registered office at Millers House, The Maltings, Roydon Road, Stanstead Abbotts, Hertfordshire, SG12 8HN. VCARS VAT number is 806075443.

  2. Neither We, AAIS, the AA nor Experian are the sellers of the cars advertised on the AA Cars website. The cars advertised are offered for sale by car dealers and private sellers. Any contract for the sale of a vehicle will be between you and the relevant car dealer or private seller.
  3. Neither We, AAIS, the AA nor Experian has undertaken any form of mechanical inspection of the vehicles advertised on the AA Cars website.     2. 4.2 AA Cars History Checks are made available to users of the AA Cars website free of charge. Access to AA Cars History Check with Data Insurance is subject to a fair use policy (maximum of 10 AA Cars History Check with Data Insurance per calendar month per person) and is made available for non-commercial purposes only. Access to free AA Cars History Checks may be withdrawn or suspended at any time without notice.
    3. 4.3 The content on the AA Cars website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the AA Cars website. In particular, We and the AA recommend that you seek the advice of a suitably qualified mechanic / vehicle expert before purchasing any car advertised on the AA Cars website.
    4. 4.4 Although We make reasonable efforts to update the information on the AA Cars website, neither We nor the AA make any representations, warranties or guarantees, whether express or implied, that the content on the site is accurate, complete or up-to-date.
    5. 4.5 Please note that the AA Cars website is provided for domestic and private use only. You agree not to use the AA Cars website for any commercial or business purposes.

    1. 5.1 AAISL is responsible (together with Experian Limited) for arranging the data insurance policy provided in connection with AA Cars History Checks with Data Insurance, as further described on the AA Cars website. None of the provisions of this clause 5 apply to AAISL's activities in arranging such data insurance policy. The terms and conditions of the data insurance policy (including the limits and exclusions) can be found here.
    2. 5.2 Neither We, AAISL nor the AA are responsible for and accept no liability for the AA Cars History Check service nor the data insurance policy provided with AA Cars History Check with Data Insurance. Experian is responsible for the AA Cars History Check service and Pinnacle is responsible for the data insurance policy provided with AA Cars History Check with Data Insurance.     3. 5.3 Neither We, the AA nor AAISL are the seller of the vehicles advertised on the AA Cars website, and we accept no responsibility for such vehicles. Please contact the seller of the vehicle if you experience any difficulties.
    4. 5.4 Nothing in these terms of use excludes or limits Our liability or the liability of the AA and / or AAISL for death or personal injury arising from our respective negligence, or our respective fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
    5. 5.5 To the extent permitted by law, We, the AA and AAISL exclude all conditions, warranties, representations or other terms which may apply to the AA Cars website or any content on it, whether express or implied.
    6. 5.6 Neither We, the AA nor AAISL will be liable to any user of the AA Cars website whether in contract, tort (including negligence), breach of statutory duty, or otherwise for the following losses and / or damage:
      1. 5.6.1 foreseeable losses;
      2. 5.6.2 direct losses;
      3. 5.6.3 loss of profits, sales, business, or revenue,
      4. 5.6.4 business interruption,
      5. 5.6.5 loss of anticipated savings,
      6. 5.6.6 loss of business opportunity, goodwill or reputation

    8. 5.8 Neither We, the AA nor AAISL assume any responsibility for the content of websites linked on the AA Cars website. Such links should not be interpreted as endorsement by Us, the AA or AAISL of those linked websites. Neither We, the AA nor AAISL will be liable for any loss or damage that may arise from your use of them.
    9. 5.9 If you are a consumer, you may have legal rights in addition to the rights set out in these terms and conditions. Advice about your legal rights is available from your local Citizen's Advice Bureau or Trading Standards office. Nothing in these terms and conditions will affect these legal rights.
  6. 6. Intellectual Property Rights
    1. 6.1 We are the owner or the licensee of all intellectual property rights in the AA Cars website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
    2. 6.2 You may print off one copy, and may download extracts, of any page(s) from the AA Cars website for your personal use and you may draw the attention of others within your organisation to content posted on the AA Cars website.
    3. 6.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

    8. 6.8 The 'Experian' and name and logo are owned by Experian Limited. We are licensed to use the same by Experian.
  7. 7. Viruses
    1. 7.1 We do not guarantee that the AA Cars website will be secure or free from bugs or viruses.
    2. 7.2 You are responsible for configuring your information technology, computer programmes and platform in order to access the AA Cars website. You should use your own virus protection software.
    3. 7.3 You must not misuse the AA Cars website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the AA Cars website, the server on which the AA Cars website is stored or any server, computer or database connected to the AA Cars website. You must not attack the AA Cars website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.       2. 10.1.2 Text Relay is available for deaf, hard of hearing or speech impaired customers.
      3. 10.1.3 We will either acknowledge your complaint within 5 working days of receipt, or offer you our final response if we have concluded our investigations within this period.
      4. 10.1.4 If we acknowledge your complaint, we will advise you who is dealing with it and when we expect to respond.  We aim to respond fully within 8 weeks.  However, if we are unable to provide a final response within this period we will write to you before this time and advise why we have not been able to offer a final response and how long we expect our investigations to take.

  11. 11. Use of your personal information
    1. 11.1 Your personal information will be used in accordance with the terms of the AA Cars privacy policy.
    2. 11.2 In particular, your personal information will be used by:
      1. 11.2.1 The AA and the Acromas group of companies who will use it for marketing and other purposes. Full details are contained in the AA Cars privacy policy; and
      2. 11.2.2 Experian Limited in connection with the AA Cars History Check service. Please see the AA Cars privacy policy for full details; and
      3. 11.2.3 Pinnacle Insurance PLC in connection with the data insurance policy provided with AA Cars History Check with Data Insurance. Please see the AA Cars privacy policy for full details; and
      4. 11.2.4 Vehicle Dealers in connection with vehicle enquiries you submit to them via the AA Cars website. Please see the AA Cars privacy policy for full details.
  12. 12. Other important terms
    1. 12.1 This contract is between you and Us. Save for the protections and rights afforded to the AA and AAISL in clauses 4.4 (Costs &Nature Of Content) and clause 5 (Our Liability To You) and to the AA in clause 6 (Intellectual Property Rights), no other person shall have any rights to enforce any of these terms under the Contracts (Rights of Third Parties) Act 1999. Neither the AA's nor AAISL's consent shall not be required to terminate, rescind or agree any variation, waiver or settlement under these terms.
    2. 12.2 Each of the clauses and sub-clauses of these terms operates separately. If any court or relevant authority decides that any of them (or any part of them) are unlawful, the remaining clauses, sub-clauses and / or part(s) of the clause or sub-clause (as appropriate) will remain in full force and effect.
    3. 12.3 If We, AAISL and / or the AA fail to insist that you perform any of your obligations under these terms, or if We, AAISL and / or the AA do not enforce our respective rights against you, or if we delay in doing so, that will not mean that We, AAISL and / or the AA (as appropriate) have waived our respective rights against you and will not mean that you do not have to comply with those obligations. If We, AAISL and / or the AA do waive a default by you, we will only do so in writing, and that will not mean that We will automatically waive any later default by you.
  13. 13. Applicable lawful
    1. 13.1 If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
    2. 13.2 If you are not a consumer, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

They do not apply to your use of the AA Cars website nor to the arranging by AAISL and Experian Limited of the data insurance policy provided with AA Cars History Check with Data Insurance.

The AA Cars History Check service is provided by Experian Limited and the data insurance policy provided with AA Cars History Check with Data Insurance is provided by Pinnacle Insurance PLC. Experian is responsible for the AA Cars History Check service and Pinnacle is responsible for the data insurance policy provided with AA Cars History Checks with Data Insurance.

The AA Cars History Check service and data insurance policy provided with the AA Cars History Check with Data Insurance are not provided by Us, AAISL or the AA and we are not responsible for them.

However, AAISL is responsible (together with Experian Limited) for arranging (on the terms set out here) the data insurance policy provided in connection with AA Cars History Checks with Data Insurance, as further described on the AA Cars website. If you choose to receive a summary AA Cars History Check via the AA Cars website, you will be entered in to a contract with Experian on these terms.

If you choose to receive a AA Cars History Check with Data Insurance you will be entered in to a contract with Experian on these terms. You will also be entered in to a policy of insurance with Pinnacle on the terms set out here.

    References to "we", "us" and "our" in these Terms and Conditions are to Experian Limited Company Number 653331).

    References to "you" or "your" in these Terms and Conditions are to you as a user of the Services.

    "AA" means Automobile Association Developments Limited (Company Number 1878835).

    "AAISL" means Automobile Association Insurance Services Limited (Company Number 2414212).

    "AA Cars History Check Service" means a summary of our used car information service to provide consumers with vehicle history information which is advertised for sale on the Website. PLEASE BE AWARE THAT THE VEHCILE HISTORY INFORMATION PROVIDED MAY BE UP TO 30 DAYS OLD.

    "Our Material" means content, data, and materials (including but not limited to information, reports, reviews, comment and opinion) delivered to you as part of the Services (whether on a computer screen, in email or paper format) including website design, text and graphics, and their selection and arrangement, and all software compilations, underlying source code and software and applets.

    "Services" means the AA Cars History Check Service.

    "Terms and Conditions" means the terms and conditions set out here.

    "Website" means a website operated on the AA's behalf by Used Cars Sites Limited (Company Number 4546950)(trading as "VCARS") at www.theaacars.com through which we provide the Services and any replacement websites used by the AA from time to time

    "Your Data" means information and data you have provided to us, the AA, AAISL or VCARS in connection with the Services, which may from time to time include Personal Data as defined by the Data Protection Act 1998 (as amended).

    1. 2.1 We are Experian Limited, a company registered in England and Wales at Companies House with company number 00653331. Our registered office is at Landmark House, Experian Way, NG2 Business Park, Nottingham NG80 1ZZ, United Kingdom. Our VAT registration number is GB 887 1335 93.
    2. 2.2 The Services are brought to you free of charge through an arrangement between us and AAISL.
  3. 3. Important information about these Terms and Conditions
    1. 3.1 These Terms and Conditions relate to your use of the Services.
    2. 3.2 We intend to rely on these Terms and Conditions and it is our intention that you will be legally bound by them when you use our Services. For your own benefit and protection you should read these Terms and Conditions carefully before using the Services. IN PARTICULAR YOUR ATTENTION IS DRAWN TO THE SECTIONS ON "OUR LIABILITY TO YOU" (Clause 9) AND OUR "WARRANTIES AND DISCLAIMERS" (Clause 8). If you do not understand any point please contact AAISL in the first instance.

    4. 3.4 You may have other consumer rights granted by law and these Terms and Conditions do not affect such rights.
  4. 4.Our Services
    1. 4.1 Each time you request a Service a binding legal contract for that Service is formed between us and you when we provide the AA Cars History Check search information
    2. 4.2 Experian AA Cars History Check Services are provided only for your personal non-commercial use. Resale of the Services is not permitted. No other person has permission to use or rely on any information provided to you by an AA Cars History Check search.
    3. 4.3 In order to conduct an AA Cars History Check search, the vehicle against which you wish to search must be registered in the United Kingdom (including Northern Ireland). For the avoidance of doubt, this does not include vehicles registered in the Channel Islands or the Isle of Man.
    4. 4.4 The Experian AA Cars History Check Service does not provide information on (a) the physical condition of any vehicle, (b) the roadworthiness or safety of any vehicle, (c) whether the vehicle has been "written off" (unless it was written off by an insurance company), (d) whether any vehicle is a "clone" bearing a false vehicle registration mark and vehicle identification number, or (e) whether any vehicle was originally purchased and/or imported from another European Union country other than the UK. You will need to make your own investigations if you require information on any of these aspects of any vehicle(s) you own or intend to purchase.

    6. 4.6 The AA Cars History Check search information may be up to 30 days old. The AA Cars History Check search information will be date stamped to show when the information was taken from our system. An up to date search can be purchased from Experian's website at www.autocheck.co.uk.
  5. 5. Pricing
    1. 5.1 The Services are free of charge.
  6. 6. Use of Our Material
    1. 6.1 You are permitted to access and make personal non-commercial use of Our Material for lawful purposes only and in a manner that does not infringe our intellectual property rights or those of third parties. Any access or use other than that which is personal non-commercial must be expressly agreed by us in writing and in advance.
    2. 6.2 You are responsible for ensuring that Your Data submitted to the Website is true and accurate and free from viruses and other harmful code.
    3. 6.3 All information delivered to you in the course of the Services and all intellectual property rights, including copyright, in Our Material belong to us or our licensors.

    1. 7.1 We take your privacy very seriously and we comply with the relevant provisions of UK data protection legislation. We will use any information given to us by you or collected by us during your use of the Website and Services only in accordance with our applicable Privacy Policy.
    2. 7.2 Please be aware that we may record telephone calls you make to our call centres for training, audit and quality purposes.
  8. 8. Warranties and Disclaimers
    1. 8.1 We will endeavour to provide the Services with reasonable care and skill and to ensure that the Services are substantially as described on the Website and in these Terms and Conditions.
    2. 8.2 We do not own or operate the Website through which the Services are provided so we make no guarantee whatsoever as to the availability or functionality of the Website or of the Services to the extent affected by the availability or functionality of the Website.
    3. 8.3 We take steps to ensure that Our Material is free from computer viruses and other harmful computer programs. However, we cannot guarantee this due to the nature of the Internet. You are advised to use appropriate firewall and anti-virus software to protect your computer and data.
    4. 8.4 We use reasonable skill and care in the sourcing and supply of the information which is made available to you on or in connection with the Services. Nothing in these Terms and Conditions will affect these legal rights. If any problems arise with your use of the Services please contact AAISL in the first instance as soon as possible.
    2. 9.2 If we fail to comply with these Terms and Conditions, we are responsible for loss or damage that you suffer that is a foreseeable result or consequence of our breach of these Terms and Conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into these Terms and Conditions.
    3. 9.3 Except as otherwise stated in clause 9.4, our aggregate liability to you arising out of or in connection with the Services provided on or in connection with the Website shall not exceed £100. THIS LIMIT OF OUR LIABILITY TO YOU REFLECTS THAT AA CARS HISTORY CHECK DATA INSURANCE IS AVAILABLE TO YOU FREE OF CHARGE AS PART OF A FULL AA CARS HISTORY CHECK SERVICE PROVIDED ON THE WEBSITE WHICH IS ALSO FREE OF CHARGE.     1. 15.1 These Terms and Conditions relate to your use of the Services.
    2. 15.2 We intend to rely on these Terms and Conditions and it is our intention that you will be legally bound by them when you use our Services.     2. 16.2 Experian AA Cars History Check Services are provided only for your personal non-commercial use. Resale of the Services is not permitted. No other person has permission to use or rely on any information provided to you by an AA Cars History Check search.

    7. 16.7 The AA Cars History Check search information may be up to 30 days old. The AA Cars History Check search information will be date stamped to show when the information was taken from our system. An up to date search can be purchased from Experian's website at www.autocheck.co.uk.
  5. 17. Pricing
    1. 17.1 The Services are free of charge and are subject to the fair use policy explained in clause 4.6.
  6. 18. Use of Our Material
    1. 18.1 You are permitted to access and make personal non-commercial use of Our Material for lawful purposes only and in a manner that does not infringe our intellectual property rights or those of third parties. Any access or use other than that which is personal non-commercial must be expressly agreed by us in writing and in advance.
    2. 18.2 You are responsible for ensuring that Your Data submitted to the Website is true and accurate and free from viruses and other harmful code.

AA Cars History Check Data Insurance is part of your Experian AA Cars History Check Service without any additional registration requirements.

AA Cars History Check Insurance

This policy will provide you with everything you need to know about your AA Cars History Check insurance, so it's important that you read your policy carefully and keep it in a safe place. This policy is subject to the terms and conditions set out below.

You will be eligible for AA Cars History Check insurance provided you:

Eligibility criteria for the insured vehicle

The insured vehicle can only be a car, motorcycle or light commercial vehicle up to 3.5 tonnes identified in the AA Cars History Check which has been purchased by you in the United Kingdom after the start date;

  1. 1. Definitions

    This policy uses words and phrases that have specific meanings. The following defined words are shown in "bold" wherever they appear throughout this policy:

    "AAISL" means Automobile Association Insurance Services Limited which is responsible for general enquiries about the AA Cars History Check and is the administration provider for complaints about how this policy was arranged;

    "AA Cars History Check" means the vehicle information service provided by Experian under an arrangement with AAISL. The service is provided via the website, in respect of the insured vehicle and is referred to on the website as "the AA Cars History Check with Data Insurance" and / or "the AA Cars History Check with data insurance";

    "Experian" means Experian Limited, Landmark House, Experian Way, NG2 Business Park, Nottingham NG80 1ZZ. Experian is the administration provider for claims under the policy and cancellations of the policy on our behalf;

    "Glass's" means Glass's Information Services Limited, 1 Princess Road, Weybridge, Surrey KT13 9TU - the provider of used vehicle valuations;

    "import" means the insured vehicle has been used outside the European Union before its first registration with the DVLA or DVA;

    "insured period" means in respect of each insured vehicle, a period of 24 months from the start date;

    "insured vehicle" means the car, motorcycle or light commercial vehicle up to 3.5 tonnes identified in the AA Cars History Check which has been purchased by you in the United Kingdom after the start date;

    "market value" means the average retail value calculated by Glass's for a vehicle of the same type, age, mileage and average condition as the insured vehicle;

    "reasonably prudent purchaser" means a purchaser who is deemed to be put on notice that the genuineness of the vehicle may not be as portrayed by the vendor and must take all precautions to avoid losses when purchasing the vehicle by carefully checking that all information supplied by the seller during the purchase is correct and following the advice on the website;

    "start date" means in respect of each insured vehicle, the date the AA Cars History Check is performed;

    "total loss insurance claim" means a claim for damage to the insured vehicle under a policy of motor insurance which is settled by the motor insurer prior to the start date by the provision of a replacement vehicle or by a monetary payment because the insured vehicle is considered to be beyond economic repair. This information must be verified by a member company of the Association of British Insurers or by Underwriters at Lloyds of London;

    "we/us/our" means Pinnacle Insurance plc who is the underwriter of this policy whose registered address is , Pinnacle House, A1 Barnet Way, Borehamwood, Hertfordshire WD6 2XX. Company No. 1007798. Pinnacle Insurance plc is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority. Cardif Pinnacle is a trading style of Pinnacle Insurance plc;

    "website" means www.theaacars.com;

    "you/yours" means the individual who is provided with the information disclosed by the AA Cars History Check and who has subsequently purchased the insured vehicle;

    The singular shall include the plural and vice versa. Within this policy, headings in this Section are only included to help you and do not form part of the insurance contract.

  2. 2. Benefits
    1. 2.1. We will, except where and to the extent that a specific warning as to the insured vehicle has been given in the AA Cars History Check, cover you for:
      1. 2.1.1. your actual financial loss within the insured period arising solely and directly from the AA Cars History Check being inaccurate or incomplete at the date of the purchase of the insured vehicle, namely:
        1. 2.1.1.1. additional payments being made by you with our agreement to secure full title to the insured vehicle, by you settling outstanding loans or other finance secured against the insured vehicle by previous owners; or
        2. 2.1.1.2. a decrease in the market value of the insured vehicle, due solely to you purchasing the insured vehicle where the insured vehicle is a salvaged vehicle following a category A or B total loss insurance claim as confirmed by the insurer making that declaration; or
        3. 2.1.1.3. the loss of the insured vehicle (or additional payments being made by you with our agreement to secure full title to the insured vehicle), due solely to the insured vehicle having been reported stolen to the police prior to the date of the purchase of the insured vehicle and you failing to obtain good title to the insured vehicle.

        In respect of any one insured vehicle, the maximum benefit payable under Section 2.1.1 shall be the market value of the vehicle on the date of receipt of a claim by us, up to a total maximum of £30,000 in respect of this policy;

      2. 2.1.2. the actual reduction in market value of the insured vehicle arising within the insured period due solely and directly from the AA Cars History Check in respect of total loss insurance claims (apart from category A or B) being inaccurate or incomplete at the date of the purchase of the insured vehicle, up to a total maximum of 50% of the purchase price of the insured vehicle or £15,000 in respect of this policy;
      3. 2.1.3. the actual reduction in market value of the insured vehicle arising within the insured period due solely and directly from the AA Cars History Check not recording the insured vehicle as an import or export vehicle at the date of the purchase of the insured vehicle, up to a total maximum of 10% of the purchase price of the insured vehicle or £3,000 in respect of this policy.
    2. 2.2. In addition to the benefits described in Section 2.1 above, we will pay you the following one-off lump sum payments, (except where and to the extent that a warning specifically limiting the benefits has been given in the AA Cars History Check):
      1. 2.2.1. £250 - where the number of previous registered keepers of the insured vehicle recorded in the AA Cars History Check does not match the number of previous registered keepers recorded with the DVLA or DVA;
      2. 2.2.2. £50 - where the insured vehicle has changed colour and this has not been recorded in the AA Cars History Check, but has been recorded with the DVLA or DVA; and/or
      3. 2.2.3. £50 - where the mileage details for the insured vehicle recorded in the AA Cars History Check does not include a previous higher mileage reading.

      You will need to provide evidence (as listed in Section 5.2.) to Experian when making a claim.

  3. 3. Exclusions
    1. 3.1. we shall not be liable for:
      1. 3.1.1. any loss, destruction or damage to the insured vehicle occurring after the start date;
      2. 3.1.2. any loss resulting from an insured vehicle which is not registered with the DVLA in the United Kingdom (or DVA in Northern Ireland) or which bears a Vehicle Registration Number with the prefix or suffix letter Q or losses in respect of vehicles registered in Jersey, Guernsey or the Isle of Man;
      3. 3.1.3. any vehicle purchased outside the United Kingdom;
      4. 3.1.4. any loss resulting from any incident prior to the insured vehicle's first registration with the DVLA or DVA;
      5. 3.1.5. any loss in respect of an insured vehicle purchased without a valid MOT Test Certificate (where compulsory);
      6. 3.1.6. the purchase of a vehicle where the Vehicle Identification Number does not correspond with the Vehicle Registration Number held by the DVLA or DVA for that Vehicle Identification Number;
      7. 3.1.7. any loss as the result of the insured vehicle bearing false Vehicle Registration Numbers or Vehicle Identification Numbers;
      8. 3.1.8. any legal costs or expenses incurred by you;
      9. 3.1.9. the cost of repair to, or refurbishment of the insured vehicle, loss of anticipated profit from its use or sale, loss of use or any financial loss connected with the loss of use or any losses relating to business interests, including without limitation, lost data, lost profits, loss of opportunity or business interruption;
      10. 3.1.10. VAT recoverable by you; or
      11. 3.1.11. any loss suffered if the purchase price of the vehicle is 30% or more below the market value and you have failed to act as a reasonably prudent purchaser; or
      12. 3.1.12. for any loss suffered where you purchase the vehicle despite any details provided by the vendor failing to accord with the AA Cars History Check.
    2. 3.2. If the insured vehicle is being bought privately (i.e. not from a motor dealer) then you must purchase the insured vehicle from the keeper stated on the V5C registration document and obtain a valid receipt. In all cases you must verify the identity of the seller by checking their photo licence and checking the name and address details on their driving licence against those recorded on the vehicle registration document (V5C).
    3. 3.3. No benefit is payable under this insurance if you at the time of the AA Cars History Check had:
      1. 3.3.1. any prior knowledge of the circumstances which give rise to a claim; or
      2. 3.3.2. failed to confirm before making the purchase that the Vehicle Identification Number (VIN) displayed on the insured vehicle matched the Vehicle Identification Number on the V5C; or
      3. 3.3.3. failed to confirm that the Vehicle Registration Number and other details provided as part of the AA Cars History Check were compatible with those of the actual vehicle.
  4. 4. Conditions
    1. 4.1. you must be at least 17 years of age to be eligible to qualify for cover under this insurance cover.
    2. 4.2. we shall have the right to inspect the insured vehicle.
    3. 4.3. At the time of claim. you shall provide to us at your own expense and in writing all details of the claim together with such proof, explanation and other evidence as may be required by (Please see Sections 5.2. and 5.3.).
    4. 4.4. All benefit under this insurance is forfeited if any claim made by you is knowingly false or fraudulent.
    5. 4.5. Where we make a payment to you under this policy for something which a third party is responsible for, we may at ourexpense take steps against that third party in your name, to obtain reimbursement or compensation from that third party. you will at ourrequest and at ourexpense help us in the conduct of those proceedings including any court proceedings by giving us any information we require and by carrying out any other act we request which will help us to recover these payments from the third party.
    6. 4.6. you shall take all precautions to avoid losses which are or may be recoverable under this insurance.
  5. 5. Claims
    1. 5.1. In the event of any occurrence giving rise or likely to give rise to a claim under this policy you must at your own expense and without delay:
    2. 5.1.1. request a claim form from Experian Claims Department, Landmark House, Experian Way, NG2 Business Park, Nottingham NG80 1ZZ Telephone: 0870 333 8030; and
    3. 5.1.2. send the fully completed claim form to Experian at the above address as soon as possible but no later than 30 days of the date of loss.
    4. 5.2. To be able to process your claim quickly Experian will always request a fully completed claim form along with supporting documentation listed below:
      1. 5.2.1. MOT certificate (if the insured vehicle is over three years old);
      2. 5.2.2. Vehicle Registration Document (V5);
      3. 5.2.3. Certificate of Insurance and a copy of your motor insurance schedule;
      4. 5.2.4. proof of purchase - copies of the original sales invoice/receipt relating to the insured vehicle; and
      5. 5.2.5. copy of the AA Cars History Check relating to the insured vehicle.
    5. 5.3. In addition to the documents listed in Section 5.2., if it becomes necessary during the course of processing your claim, Experian may ask you for proof of refund or compensation relating to the insured vehicle.

      If any documents requested in Sections 5.1., 5.2. and 5.3.are not received promptly Experian's claims assessment process will be delayed which may prevent your claim from being paid.

      If the name of any document changes e.g." MOT certificate" or "Vehicle Registration Document (V5)", Experian will require you to send the document which takes its place.

      If you are unable to supply any of the documents listed in Sections 5.1., 5.2. and 5.3., Experian may ask you for alternative documents.

    6. 5.4. We have a regulatory obligation to prevent fraud. In the event of a claim, any information you have supplied relevant to this insurance and on the claim form, together with other information relating to the claim may be shared with other insurers in order to prevent fraudulent claims.
    7. 5.5. If we make any payments as a result of dishonesty or exaggerated behaviour by you or by someone acting on your behalf), you will not be entitled to any benefits under this policy and we may demand that any claims payments made under this policy are paid back to us. We may take legal action against you to return any money owed to us and may demand that you reimburse us for any costs incurred.
  6. 6. Terms and conditions
    1. 6.1. We may vary or waive your terms and conditions to:
      1. 6.1.1. improve your cover;
      2. 6.1.2. comply with any applicable laws or regulations; or
      3. 6.1.3. correct any typographical or formatting errors that may occur.
    2. 6.2. you will be given at least 30 days' written notice to your last known address of any alteration to the terms and conditions of cover under this policy unless the change is due to legislative or regulatory requirements. If your cover is changed due to legislative or regulatory changes which are outside our control, then we may not be able to give you 30 days' notice.
    3. 6.3. If your terms and conditions are varied or waived and you do not wish to continue your cover, you can cancel as set out in Section 7.

  8. 8. Our right to cancel
    1. 8.1. Cover may be cancelled immediately:
    2. 8.1.1. where there is evidence of dishonesty or exaggerated behaviour by you (or by someone acting on your behalf) in relation to the cover provided under this policy;
    3. 8.1.2. where you deliberately tell us something which is untrue or misleading in response to any question we ask you when you take out cover under this policy, or when amending your policy (or we can demonstrate from the relevant circumstances that you did not take reasonable care to ensure the statements you made to us were true);
    4. 8.1.3. where you have unintentionally misrepresented a material fact which, if correctly represented at the time of application, would have caused us to decline you for cover;
    5. 8.1.4. where necessary to comply with any applicable laws or regulations; or
    6. 8.1.5. the insured vehicle is not eligible for cover under this policy;
  9. 8.2. Any decision we take to cancel cover will not be made at an individual level and will not be based on whether you have made a claim. Except in cases of dishonesty or exaggerated behaviour, misrepresentation or when asked failure to disclose a material fact by you or by someone acting on your behalf.
  10. 8.3. Except in cases of dishonesty or exaggerated behaviour, misrepresentation or when asked failure to disclose a material fact by you or by someone acting on your behalf, cancellation of your policy will not affect your entitlement to claim for any event occurring before the date of cancellation.
  11. 9. General Conditions
    1. 9.1. The contract between you and us is made up of this policy and any endorsement to this policy.
    2. 9.2. This policy cannot be assigned or charged in any manner whatsoever.
    3. 9.3. This policy shall not acquire a surrender or cash value.
    4. 9.4. This policy shall be governed by English law. Any legal proceedings will be held in the courts of England and Wales unless you live in Scotland, Northern Ireland, the Channel Islands or the Isle of Man, in which case you will be entitled to commence legal proceedings in your local courts.
    5. 9.5. We are covered by the Financial Services Compensation Scheme (FSCS). If we are unable to meet our liabilities to you, you may be entitled to compensation from the FSCS. Further information is available from their website: www.fscs.org.uk
    6. 9.6. you must respond honestly to any request for information we make when you take out cover under this policy, or apply to amend your cover under this policy. In the event that any statement of fact you make is untrue or misleading, this may affect the validity of your policy, and whether you can make a claim.

Examples include the internet protocol (IP) address used to connect your computer to the internet, connection information such as browser type and version, your operating system and platform, a unique reference number linked to the data you enter on the AA Cars website system, login details, the full URL clickstream to, through and from the AA Cars website (including date and time), cookie number, activity on the AA Cars website including the pages you visited and searches you made.     Yes.     Where you contact a vehicle dealer using the contact forms on the AA Cars website, the information you input will be transmitted to the relevant vehicle dealer. Neither VCARS nor the AA has any control over such third parties and recommend that you review and check that you are happy with their privacy policies before you submit any data to them.

    VCARS may also supply vehicle dealers with a log showing details of calls made to those dealers through use of the relevant telephone numbers shown on the AA Cars website. VCARS will ordinarily disclose only part of the telephone number from which the call was made. VCARS may also supply dealers with recordings of those telephone calls.

    VCARS: VCARS will use your personal data to provide you with the AA Cars website and associated functionality, as more particularly described in the full privacy policy set. VCARS will not use your personal information for marketing or promotional purposes.

    AA: Automobile Association Insurance Services Limited (Company number: 02414212) will use your personal information to arrange the AA Cars History Check and associated data insurance policy (provided by Pinnacle Insurance PLC) where you elect to receive the same.

    The AA (and the Acromas group of companies) will also use your personal information in accordance with the Acromas privacy policy which can be found here. The AA and the Acromas group of companies will, amongst other things, use your data for marketing and promotional purposes.

    Experian & Pinnacle: Where you choose to receive an AA Cars History Check, Experian will use your data on behalf of the AA in order to provide the AA Cars History Check. Experian (and the Experian group of companies) will also use your personal information in accordance with the Experian privacy policy which can be found here.

    Where you choose to receive a AA Cars History Check with Data Insurance, Pinnacle will process your personal data to provide the data insurance policy provided with the same. Neither Experian nor Pinnacle will use your personal information for marketing or promotional purposes.

    Vehicle Dealers: Where you elect to contact a vehicle dealer using the contact forms on the AA Cars website, the relevant vehicle dealer will use your personal information to respond to your enquiry. They may also use your personal information for call monitoring and customer service purposes.

      Where you elect to receive a AA Cars History Check with Data Insurance, Experian will share your personal information with Pinnacle Insurance PLC, the provider of the data insurance policy provided with AA Cars History Check with Data Insurance.

    3. 5.3 Service Providers: VCARS may allow access to your personal data by third parties who supply us with a service - for the purpose of their service only and in accordance with VCARS instructions. Examples include website hosts and businesses which assist us in undertaking communications or monitoring the AA Cars website. VCARS will not permit any third parties to use your personal information for marketing or promotional purposes, save for the AA and the Acromas group of companies - click here for full details.
    4. 5.4 Dealers: The contact details and other information you supply in email enquiry forms on VCARS website is transmitted to the relevant vehicle dealer. VCARS require that dealers use such data only in accordance with applicable data protection laws and regulations.
    5. 5.5 VCARS may supply vehicle dealers with the log showing details of calls made to those dealers through use of the relevant telephone numbers shown on the AA Cars website. VCARS will ordinarily disclose only part of the telephone number from which the call was made. VCARS may also supply the dealer with recordings of those telephone calls. The purpose of VCARS collection and disclosure to dealers of such telephone data is to enable us and VCARS partners to monitor telephone traffic via the AA Cars website and also to enable dealers to review the quality of their telephone call handling and for customer service training. VCARS will delete recordings after 6 months.
    6. 5.6 VCARS may disclose personal data so far as reasonably necessary:
      1. if VCARS think you have or may have breached the AA Cars website terms and conditions or to enforce VCARS rights or protect the public or where VCARS have reasonable grounds for believing that a criminal act has been committed) or if VCARS are required to do so by law or appropriate authority; or

The AA Group ('we' 'us') means AA plc, together with any entity in which AA plc directly or indirectly has at least a 50% shareholding. How we use your information

We use the information we receive from you, together with information we have obtained from our dealings with you (including in relation to goods and/or services we provide to you and/or your use of those goods and/or services), to provide goods and/or services that you request, to communicate with you, and to personalise information sent to you. Examples of how we may personalise information include using your information in generating an insurance quote for you or when we will be delivering certain products in your area.

To help us prevent fraud and money laundering, your details may be submitted to fraud prevention agencies and other organisations where your records may be searched. We will also conduct a search with a credit reference bureau to assist us in providing a quote, and to check which payment options we can make available to you. A copy of this search will be left on your credit file but will not affect your credit score. Where we are providing a motor insurance quotation this search will be noted on your credit file and may be reflected in your credit score.

Third parties may deliver some of our products to you, or provide all or part of the service requested by you. In these instances, while the information you provide will be disclosed to them, it will only be used for the administration of the service provided (including for example verification of any quote given to you and claims processing), underwriting and pricing purposes as appropriate, testing, and to maintain management information for business analysis.

Where users of the AA Cars website elect to receive a full Experian Auto Check, Automobile Association Insurance Services Limited (Company number: 02414212) will use their personal information to arrange the associated data insurance policy (provided by Pinnacle Insurance PLC) provided as part of the AA Cars History Check with Data Insurance, and their personal information will be disclosed to Experian and Pinnacle accordingly. Experian will use and Pinnacle will process such personal information to provide and administer the such AA Cars History Checks and the associated data insurance policy(ies) (where applicable).

If you apply for the AA Credit Card, we, or the supplier of the card, will search your record at a credit reference agency. If you apply for other financial services and/or products, a check of your details with fraud prevention agencies may be necessary. The precise nature of these processes is explained fully when you apply.

We ask for your home, mobile phone number, and email address to enable us to contact you in relation to an enquiry you have made, to contact you about relevant products or services, to contact you if there is a problem with your order, or there is another genuine reason for doing so.

We make outbound phone calls for a number of reasons relating to our many products, including breakdown cover and insurance. We are fully committed to the regulations set out by Ofcom and follow strict processes to ensure we comply with them.

If you provide us with credit or debit card details in order to pay for a service or product, we will keep such details secure and ensure that the details are only used further with your consent and/or for the purposes of any appropriate refunds.

When you enter a contest or other promotional feature, we may ask for your name, address, phone numbers and email address so we can administer the contest and notify winners.

Occasionally, we may also use the information we collect to notify you by post, phone, mobile phone, email and SMS about new or existing services, products and special offers we think you'll find of interest.

We may use sensitive personal data collected in respect of one product to market another appropriate product to you.

Generally by providing the requested data you consent to us using that data for administrative purposes and for informing you of other products and services by letter, SMS, phone and/or email. From time to time the AA Group may use service providers and organisations outside the EEA for the purpose of processing services, system testing and maintenance.

It is worth noting, however, that some non-EEA countries do not afford the same level of data security as the UK. By submitting your details you consent to this transfer. We will always use every reasonable effort to ensure sufficient protections are in place to safeguard your personal information.

Subsequent to your purchase of a product or service, we may enter into an arrangement for that service to be provided by a new third party. If you are entitled to breakdown service under AA membership you consent to the AA Group keeping you up to date with the AA Rewards discount scheme or similar available from time to time. Under this, as part of the benefit of being a member, the AA Group will, through the AA members' magazine, email or otherwise, give you membership information and details of any discounts or offers it may negotiate from time to time on behalf of its members.

Disclosure of information to third parties

As previously mentioned, we do not sell, trade or rent your information, and will never disclose information about you (including information obtained from our dealings with you) to third parties, except:

a) to fulfil your specific orders for a product or service or information in the event that third parties deliver the relevant product or service or information. The AA Group have adopted the following procedure in gaining your consent to be placed on its marketing lists.

When you first make an enquiry of or buy a product from the AA Group you consent to receiving marketing about other products and services from us. Your details are placed on our marketing list for the AA Group and a 'questionnaire' will be sent to you; it may be sent electronically. This questionnaire gives a list of all the products of the group, and the option of choosing which products you would or would not like to receive information about. Amendment and retention of information

Internet Explorer 7.0 and 8.0

  1. 1. From the menu choose Tools
  2. 2. Then Internet Options
  3. 3. On the General tab, under Browsing history click Settings
  4. 4. Click View files
  5. 5. Click the Name column heading to alphabetically sort the files
  6. 6. Scroll down to files that begin with the prefix cookie: – all cookies have this prefix, and they usually contain the name of the website that created the cookie
  7. 7. Right-click to delete a cookie you want to remove
  8. 8. Close the window, then click OK twice to return to the browser window

FireFox 1.0, 2.0 and 3.0

  1. 1. From the menu choose Tools
  2. 2. Then Options
  3. 3. Click the Privacy icon and then Show Cookies
  4. 4. Select a site from the list and click Remove Cookie(s)
  5. 5. To remove all sites click Remove All Cookies

FireFox up to 11.0

  2. 2. Then Options
  3. 3. Click the Privacy icon
  4. 4. In History, click remove individual cookies
  5. 5. Select a site from the list and click Remove Cookie

  4. 4. In Privacy click Content settings
  5. 5. In Cookies click the button All cookies and site data
  6. 6. Select a site from the list and click X

  3. 3. Click the Security icon and then Show Cookies
  4. 4. Select a cookie from the list and click Remove
  5. 5. To delete all cookies click Remove All
